Terms and Conditions for Public Records Requests

By submitting a public records request to our agency, you agree to the following terms and conditions:

  1. Compliance with Idaho Code
    Requests for public records are governed by Idaho Code Title 9, Chapter 3 (Idaho Public Records Act). Certain records may be exempt from disclosure as specified by law. Exemptions may include, but are not limited to, records that would compromise the safety, security, or privacy of individuals or investigations.

  2. Accurate and Specific Requests
    To ensure efficient processing, requests must include detailed and accurate information about the records being sought, such as incident details, case numbers, and individual information. Vague or overly broad requests may result in delays or an inability to locate the requested records.

  3. Processing Time
    The agency will make reasonable efforts to respond to your request within the time-frame specified by Idaho law, typically within three (3) business days. If additional time is needed to locate or review records, you will be notified within this period, and the response time may be extended to ten (10) business days.

  4. Fees and Payment
    Fees may apply for copies, staff time, and other associated costs. You will be notified of any applicable fees before the records are released. Payment must be received before records are provided.

  5. Limited Disclosure
    The information provided in response to your request may be redacted or limited to comply with legal exemptions. The agency is not responsible for providing interpretations, summaries, or explanations of the records.

  6. Use of Records
    Records obtained through this request are provided for informational purposes only and must not be used for unlawful purposes. Misuse of public records may be subject to legal action.

  7. No Guarantee of Completeness
    The records provided may not constitute a comprehensive account of the incident, individuals, or situation. Additional resources may be necessary for a complete understanding.

  8. Hold Harmless Clause
    By submitting this form, you agree to release, indemnify, and hold harmless the Buhl Police Department, its officers, employees, and agents from any and all liability, claims, or damages arising from or related to the use of this form, the information submitted, or the handling of the report, except where prohibited by law.
